Terms of Service

Effective Date: July 24, 2025

By using Valix’s services, including our SMS loyalty platform (“Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service.

Valix helps restaurants grow revenue through SMS-based loyalty campaigns. We provide setup, campaign strategy, platform integration, and performance tracking tailored to your business.

• Pricing varies by business needs, customer volume, and messaging frequency.
   
• SMS message fees are billed separately based on usage.
   
• All plans are month-to-month unless otherwise agreed.
   
• No refunds on platform fees after campaign work begins.
   

• You must ensure that customer phone numbers are collected with proper consent in compliance with applicable laws (e.g., TCPA).
   
• You are responsible for the accuracy of the data you provide.
   
• Valix is not liable for violations arising from your use of customer data.
   

• Either party may cancel service with 30 days’ written notice.
   
• Upon cancellation, you retain ownership of your customer data.
   
• You may request that we delete all stored data within 30 days of cancellation.
   

Valix retains ownership of all tools, templates, and systems used to deliver the Service. You own your business’s customer data and campaign content.

Valix is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount paid for Service in the 30 days prior to any claim.

These Terms are governed by the laws of the State of Utah. Any disputes will be resolved in the state or federal courts located in Utah.

We may update these Terms periodically. We’ll notify you at least 30 days in advance. Continued use after changes indicates acceptance.
